Intellectual Property Complaints Policy
This Intellectual Property Complaints Policy explains how Rexplore Inc. ("Rexplore," "we," "us," or "our") handles copyright, trademark, publicity-right, and other intellectual property complaints relating to the Rexplore family of services, including Rextaurant, Rextrip, and Rexhotel (collectively, the "Platform"). This Policy supplements our Terms of Service and does not create any obligation beyond what applicable law requires.
1. Scope and General Approach
1.1 Rexplore Inc. operates Rexplore as an information platform that hosts and organizes user-submitted and third-party information. We do not guarantee that any complaint will be accepted, that any content will be removed, or that any private dispute between third parties will be resolved in any particular way.
1.2 We may review notices of alleged infringement or misuse, request additional information, remove or disable access to material, reject incomplete notices, preserve evidence, notify the affected user, or take no action where we determine a notice is deficient, abusive, legally unsupported, or otherwise inappropriate.
1.3 We may act on complaints in good faith and without liability to you for removal, disabling, restoration, preservation, or disclosure decisions made to protect the Platform, users, rights holders, or Rexplore.
2. How to Submit a Copyright Notice
If you believe content on the Platform infringes your copyright, send a notice to legal@rexplore.xyz. If you intend your notice to comply with 17 U.S.C. § 512(c)(3) or any similar law, you are responsible for ensuring that your notice contains all legally required information.
Your notice should include, at a minimum:
- your full name, company name if applicable, email address, and any other contact details reasonably needed to reach you;
- a description of the copyrighted work you claim has been infringed;
- the exact URL or sufficient information for us to locate the allegedly infringing material;
- a statement that you have a good-faith belief the disputed use is not authorized by the rights holder, its agent, or the law;
- a statement that the information in the notice is accurate and, where required, that you are authorized to act on behalf of the rights holder;
- your physical or electronic signature.
3. Counter-Notifications
If your content was removed or disabled because of a copyright complaint and you believe the complaint was mistaken or that you have the right to use the material, you may send a counter-notification to legal@rexplore.xyz.
A counter-notification should include:
- your name, address, email address, and other contact details reasonably needed to reach you;
- identification of the removed or disabled material and its location before removal or disabling;
- a statement, under penalty of perjury where applicable, that you have a good-faith belief the material was removed or disabled by mistake or misidentification;
- where required by applicable law, a statement consenting to the jurisdiction of the appropriate court and accepting service from the complaining party or its agent;
- your physical or electronic signature.
We may forward a valid counter-notification to the complaining party and may restore the material if permitted or required by law, but we are not obligated to restore any material in every case.
4. Trademark and Other IP Complaints
For trademark, trade dress, publicity-right, database-right, or other IP complaints, contact legal@rexplore.xyz and include enough information for us to evaluate the claim, including the right allegedly infringed, the material at issue, the basis of your claim, and your authority to act.
We may request evidence of your rights, evidence of likely confusion or misappropriation, proof of authorization, proof of identity, or additional supporting materials before taking action.
5. Repeat Infringer and Abuse Policy
Rexplore may suspend, restrict, or terminate accounts of repeat infringers or users who repeatedly submit infringing, deceptive, or unlawful content. We may also restrict or disregard complainants who repeatedly submit false, abusive, automated, or bad-faith notices.
6. Our Rights and Discretion
We may, in our sole discretion and to the maximum extent permitted by law:
- remove, disable, geo-restrict, annotate, or preserve content;
- share complaint details with the affected user or relevant third parties where reasonably necessary;
- request more information before acting;
- decline to adjudicate private ownership or licensing disputes;
- comply with court orders, legal process, or regulator requests;
- retain complaint records, counter-notices, correspondence, and supporting evidence for legal, compliance, fraud-prevention, and platform-integrity purposes.
7. Misrepresentation and False Notices
Submitting a false, misleading, abusive, or bad-faith complaint or counter-notification may expose you to legal liability. Rexplore reserves all rights to pursue remedies and to seek indemnification where permitted by our Terms of Service and applicable law.
8. No Duty to Adjudicate Private Disputes
Rexplore is not a court, arbitrator, or rights registry. We are not required to decide ownership, fair use, licensing scope, trademark priority, or other complex legal questions. If a dispute cannot be reliably resolved from the materials provided, we may require the parties to resolve the matter directly or through appropriate legal channels.
